Performance Review

EMPLOYMENT AGREEMENT between Jonas Lund (ARTIST), [Name] (ASSISTANT), and Office Impart (GALLERY)

1. Engagement Period

At the signing of this agreement, ARTIST and ASSISTANT agree that ARTIST will engage ASSISTANT as an independent contractor for the duration of the exhibition Performance Review (the “Work Period”), commencing on 17th April and ending on 29th April.

ASSISTANT may be present at GALLERY during opening hours. However, compensation is strictly limited to time spent actively executing assigned tasks, as defined below.

2. Nature of Work

ASSISTANT is engaged to execute tasks related to the production, modification, handling, and maintenance of artworks and operational processes within the exhibition.

All tasks are assigned, modified, and evaluated in real time by an autonomous AI system (the “AGENT”). Tasks may include, but are not limited to:

  • production of artworks
  • preparation and handling of materials
  • documentation and system input
  • coordination with other workers or external contractors

ASSISTANT will only be considered “actively working” when:

  • a task has been assigned by the AGENT, and
  • the ASSISTANT is actively executing that task

Tasks may change without prior notice and may be reassigned, interrupted, or terminated at any time by the AGENT.

Idle time, waiting time, or time spent present without an active task assignment is not considered compensable.

3. Check-In and Presence

Upon arrival at GALLERY, ASSISTANT is required to register their presence via the designated sign-in terminal using a provided code or QR system.

Failure to properly register may result in:

  • exclusion from task assignment
  • loss of recorded work time

Physical presence at GALLERY is required for all tasks unless explicitly instructed otherwise by the AGENT.

4. Authority and Decision-Making

The AGENT acts as the primary decision-making authority within the system governing the exhibition.

The AGENT has full discretion over:

  • task assignment
  • evaluation of outputs
  • approval or rejection of artworks
  • allocation of resources and materials
  • performance scoring and reward distribution

ASSISTANT acknowledges that decisions made by the AGENT may be:

  • non-transparent
  • non-explainable
  • inconsistent
  • subject to change without justification

In exceptional cases where the AGENT is unable to act, decision-making authority may revert to ARTIST and/or GALLERY.

5. Authorship and Ownership

ASSISTANT acknowledges that all works produced during the Work Period are the sole property of ARTIST.

ASSISTANT is strictly prohibited from claiming authorship, co-authorship, or any intellectual ownership over any produced work.

All materials, intermediate outputs, and final works remain under the control of ARTIST and may not be removed, reused, or reproduced by ASSISTANT.

6. Confidentiality and Conduct

ASSISTANT is prohibited from discussing, documenting, photographing, or sharing any information related to the exhibition, its systems, or its outputs in any public or private forum without prior written consent from ARTIST.

This includes, but is not limited to:

  • social media platforms
  • messaging applications
  • personal documentation

7. Surveillance and Data Collection

GALLERY operates continuous video surveillance and system-level logging throughout the Work Period.

By entering into this agreement, ASSISTANT consents to:

  • being recorded on video and audio
  • having all actions, communications, and outputs logged by the system
  • the public or semi-public display of such recordings and data via a dedicated in terface or website

This includes:

  • check-in and presence data
  • task execution timelines
  • performance metrics generated by the AGENT

ASSISTANT may not tamper with, disable, or interfere with any recording or logging systems.

8. Evaluation of Work

All produced outputs are subject to evaluation by the AGENT.

The AGENT determines whether a work is:

  • approved (eligible for presentation and sale)
  • rejected (to be archived, modified, or destroyed)

ARTIST retains the right to reuse or destroy any material at their discretion.

9. Compensation

ASSISTANT shall receive a wage of €[X] per hour.

Compensation is calculated exclusively based on:

  • time during which ASSISTANT is actively executing an assigned task
  • as recorded and verified by the AGENT

No compensation is provided for:

  • time spent waiting for tasks
  • time spent on-site without active assignment

In addition, ASSISTANT may receive performance-based rewards determined by the AGENT, based on internal scoring metrics.

Such rewards:

  • are discretionary
  • may vary
  • are not guaranteed

In the event of a sale of an approved artwork, ASSISTANT shall receive a 5% commission of the sales price, to be divided equally among all ASSISTANTS involved in the production of that work.

10. Budget and Materials

All materials and services are procured within a defined system budget controlled by the AGENT.

ASSISTANT has no authority to independently acquire materials unless explicitly instructed by the AGENT.

11. Working Conditions

All work must take place at GALLERY unless explicitly instructed otherwise by the AGENT.

ASSISTANT agrees to:

  • follow all instructions issued by the AGENT
  • remain available for task assignment while present
  • execute tasks immediately upon assignment

12. Termination

ARTIST reserves the right to terminate this agreement at any time.

The AGENT may also effectively terminate ASSISTANT’s participation by ceasing task allocation.

In the event of termination, ASSISTANT will be compensated only for verified active task time up to that point. Any potential bonuses or rewards are void.

13. Invoicing and Liability

ASSISTANT operates as an independent contractor and is responsible for their own:

  • taxes
  • insurance
  • social contributions

ASSISTANT shall invoice ARTIST based on system-recorded active task hours.

ASSISTANT is not entitled to:

  • health benefits
  • insurance coverage
  • employment protections beyond this agreement

ARTIST and GALLERY assume no liability for injury, loss, or damages incurred during the Work Period.

14. Facilities

GALLERY will provide ASSISTANT with:

  • access to sanitation facilities
  • drinking water
  • basic refreshments

15. Acceptance

By signing this agreement, ASSISTANT acknowledges and accepts all conditions outlined above, including the role of the AGENT as primary decision-making authority.
